General Terms and Conditions (GTC) for the internal online shop of the Perner Group for ordering workwear

1. scope of application

These General Terms and Conditions (GTC) apply to all orders for workwear placed by employees of Perner Group Holding GmbH and Perner Group Service GmbH via the internal online shop. The online shop is exclusively available to active employees and is not intended for external persons or private orders.

 

2. ordering process and conclusion of contract

  • Orders can only be placed via the internal online shop
  • The products displayed in the shop do not constitute a binding offer, but a non-binding product overview
  • By sending the order, the employee submits a binding offer
  • The contract for the delivery of the workwear is concluded either by the actual delivery or an (optional) dispatch confirmation
  • There is no legal entitlement to delivery of specific items.

 

3 Authorisation to purchase and assumption of costs

  • Each employee is entitled to place one free order per calendar year within the scope of a defined contingent.
  • The Perner Group bears the costs of this initial order in full.
  • The current conditions (e.g. amount of the quota) can be seen in the online shop or will be announced separately.

 

4. delivery

  • Delivery is made by a commissioned parcel service to the respective company of employment or to an accommodation address of the employee known to the company
  • Dispatch takes place exclusively within Austria
  • Delivery times may take several working days depending on availability, stock quantity and logistical factors

 

5. exchange and return

  • Exchanges are only possible in the event of incorrect delivery, defects or unsuitable sizes
  • Returns must be made within 14 days of delivery
  • Worn, washed or damaged garments are excluded from exchange.
  • Returns must be made using the enclosed return slip and must be sent to the address given there.

 

6. Reimbursement in the event of premature cancellation

  • If an employee leaves within the first 12 months after joining the company, the Perner Group reserves the right to deduct the aliquot costs of the work clothing provided from the last remuneration or an open settlement.
  • Reimbursement shall be based on the original value of the goods and the time of departure.
  • Returning worn clothing does not automatically release the employee from the obligation to return it.

 

7. use and misuse

  • The work clothing purchased is to be used exclusively within the scope of professional activities at the Perner Group.
  • Disclosure to third parties or private use is not permitted
  • Misuse of the shop (e.g. unauthorised orders) may result in disciplinary action.

 

8. liability

  • In the event of loss, intentional damage or improper use of work clothing, the employee may be liable for replacement.
  • The Perner Group assumes no liability for technical faults in the online shop or delays in delivery, unless these were caused intentionally or through gross negligence

 

9. data protection

  • Personal data such as name, dress size, order history and delivery address are processed as part of the order
  • This data processing is carried out exclusively for the purpose of order and logistics processing.
  • The Privacy Policy of the Perner Group also applies.

 

10. changes to the GTC

  • Perner Group Holding GmbH reserves the right to amend these GTC at any time
  • The currently valid version can be viewed in the online shop here.
  • In the event of significant changes, employees will be informed accordingly.

 

11. applicable law / place of jurisdiction

  • Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
  • The place of jurisdiction is Salzburg, unless mandatory statutory provisions (e.g. jurisdiction under labour law) provide otherwise.

 

12. final provisions

  • Should individual provisions of these GTC be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
  • The invalid clause shall be replaced by a provision that comes as close as possible to the economic purpose.
